The Nevada Supreme Court on February 25th issued an Advance Opinion reversing the district court’s decision, which invalidated Order #1293A issued by the State Engineer that required the relinquishment of two acre-feet of water rights for every new domestic well drilled.

Hardesty, Chief Justice requesting that the Nevada Supreme Court consider creating a Commission to Study the Adjudication of Water Law Cases in Nevada’s Courts. AB5 & AB6 to be heard by Assembly Natural Resources Committee Monday March 1
Assembly Bill (AB)5 and AB6 which were requested by the Division of Water Resources will heard by the Assembly Committee on Natural Resources on Monday March 1st. The Committee hearing begins at 4 p.m. AB5 makes various changes to provisions relating to judicial review of orders and decisions of the State Engineer. AB6 revises provisions governing an application for a temporary change relating to appropriated water. Specifically, AB6 makes the holding of a hearing on an application for a temporary change to the place of diversion, manner of use or place of use of water application discretionary.

The Division of Water Resources has not set a date for a public workshop on this proposed regulation, and the Division does not plan on setting any additional public workshops until after the conclusion of the (2021) legislative session.
